BCDR Official Rules

NO PURCHASE IS NECESSARY TO PARTICIPATE OR WIN AND PURCHASES ARE NOT REQUIRED TO IMPROVE YOUR CHANCES OF WINNING. 

BY PARTICIPATING, YOU AGREE TO THESE OFFICIAL RULES, OUR TERMS OF SERVICE, AND PRIVACY POLICY. THIS IS A CONTRACT, WITHOUT LIMITATION, AND IT INCLUDES LIMITATIONS ON YOUR RIGHTS AND REMEDIES. ANY DISPUTES ARE GOVERNED BY RULE 28 & 29 AND YOU AGREE TO BE BOUND BY THESE REQUIREMENTS INCLUDING BINDING ARBITRATION. 

YOU WILL NEED INTERNET ACCESS AND A VALID EMAIL ADDRESS TO PARTICIPATE AND CLAIM ANY AWARDED PRIZE(S). 

EACH WINNER IS REQUIRED TO PARTICIPATE IN THE PRIZE FULFILLMENT PROCESS. IN ORDER TO OBTAIN YOUR PRIZE YOU WILL BE REQUIRED TO SIGN ADDITIONAL AGREEMENTS, RELEASES, AND OTHER REQUIRED DOCUMENTATION. 

In this Agreement Blue Collar Dream Rides (BCDR) refers to Blue Collar Dream Rides and its employees, representatives, affiliates, vendors, officers, heirs, ensigns, or partners. The “Participant” and “you”,  “your”, “you’re” refers to any one enrolled in BCDR membership, participating in BCDR project, or submitting a BCDR handwritten entry.

 

These Official Rules together with our BCDR Privacy Policy and BCDR Terms and Conditions and any Privacy Notices or click-through agreements, contain the entire understanding and agreement between you (“user”) and BCDR with respect to this site, our social media presence, or any of our online services and it supersedes all previous communications, negotiations, and agreements, whether oral, written, or electronic, related to any understanding or agreement.

Parties

Throughout this agreement “we”, “us”, “our” and “ourselves” along with “Blue Collar Dream Rides” and “BCDR” refers to Blue Collar Dream Rides its subsidiaries, owners, shareholders, directors, officers, partners, employees, agents, vendors, heirs, and any other affiliated party – unless otherwise noted. “You”, “your”, “yourself”,  and “user” refers to anyone accessing our Sites and includes the company, entity or agency that the user represents. 

  1. The “BLUE COLLAR DREAM RIDE GAME AND SWEEPSTAKES®” (the “Game”) consist of periodic no purchase necessary randomly selected winner drawings for completed vehicle Projects to be conducted at each Project’s listed Final Award Date on our site www.bluecollardreamrides.com. 

    1. “Project” – A BCDR produced vehicle selected by majority vote or BCDR’s discretion and including the options (e.g. paint, interior, wheels, etc.) selected by majority votes and/or BCDR’s discretion. The vehicle’s work, production, and final completion is governed solely by BCDR and its determination of the majority winning options. All remaining options required for a complete Project are BCDR’s sole discretion.

    2. Option Selection Process – Each option, including the selection of the vehicle, has a final date by which an option must be selected. Each option, including the selection of the vehicle, requires a “Minimum Vote Requirement” (“MVR”). If the MVR for each option is not met by the final date listed on the Project’s page, a final selection will be made by BCDR based on majority, or if necessary, BCDR’s discretion. From time to time, certain options, including vehicles, may not be available for various reasons outside of BCDR’s control. When feasible, BCDR will provide notice, and the next available option with the second highest vote total will be selected. Should the second option no longer be available, BCDR will use it’s discretion to select the options. You are not entitled to compensation, refunds, or new votes except where required by law. 

    3. Vote Totals – Voting totals are regularly updated on the site. These vote totals may or may not reflect the actual vote totals due to delays in data processing, failures of service and equipment, your internet connection and equipment, services and equipment failures outside of BCDR’s control, and various acts outside of BCDR’s control such as acts of God, vandals, illegal actors, etc. By using the site you understand that the listed Vote Totals are not necessarily up to date and BCDR’s offers no promises, warranties, or guarantees based on the listed Vote Totals. 

    4. Final Award Date – Each Project will have a listed Final Award Date on the Project’s page. This date follows the completion of the various options final date. Once all voting and Project award entries, including handwritten no purchase necessary entries, have been collected, counted and verified, a winner will be selected from all valid and verified entries via an electronic system that will randomly select the potential winning entry (subject to Rule 16). The “Potential Winner” will be notified and BCDR will post the necessary information related to the results on it’s website. 

    5. In the event that the vehicle cannot be completed due to insufficient participation, third party action/inaction, acts of God or other contingencies outside of BCDR’s control a $5,000.00 cash prize will be awarded in lieu of a Final Project. 

  2. Entry/Entry Credits – Each membership subscription entitles you to 5 Entry Credits that allow you to vote for your favorite option(s) on a selected Project(s). You may also purchase votes, each vote purchase entitles you to one Entry Credit. Once you vote on the option of your choice for the Project of your choice you’re Entry Credit is automatically applied to that Project’s Final Project Drawing. Void where prohibited. 

  3. All times mentioned in these Official Rules are Pacific Standard Time (“PST”). A day is the 24-hour period beginning at 12:00:00 a.m. and ending that same day at 11:59:59 p.m. (“day”).

  4. Eligibility

    1. The Game is only open to those who are: 

      1. 18 years of age or older at the time of participation; 

      2. Residents of the United States and its territories, except where excluded by law; 

      3. Not an agent, officer, employee, or independent contractor of Blue Collar Dream Rides or its affiliates; 

      4. Not an immediate family member (any father, mother, spouse, child, or IRS-dependent, that is related by biology, marriage, adoption, foster care, or civil union), or resides in the same household as, any person listed.

    2. To win you must be, and remain in, compliance with these Official Rules. We reserve the right to disqualify any potential winner who we believe is not permitted by law to receive a prize or who is not in compliance with the Official Rules.

  5. We’re excited to have you participate in the Games and we offer several ways do so and purchasing membership or votes will not increase your chances of winning based on that entry:

    1. Voting vouchers – every purchase of a vote/voting voucher for your favorite options on the Dream Ride Project of your choice comes with a free entry into our random drawing for that project “Final Project Drawing” on its Award Date. These entries are credited to your member account, only members may participate in voting, but anyone can participate in the sweepstakes drawing (Rule 5.c) Your purchase will not increase your odds of winning. Your account voting credits may be submitted for the project of your choice at any time for the duration of the project’s voting period. Simply select the project option of your choice (e.g. paint style, wheels, etc.). Every vote provides an entry into the final drawing for that project. Once your voting credit(s) is spent it is not redeemable or returnable. 

    2. Membership – by joining the Blue Collar Dream Ride club you’ll automatically be given a specified number of entry credits into the Dream Ride Project of your choice. These credits may be spent according to the methodology described above. Membership entry is detailed on the website, and below, but minimally requires a membership fee, first and last name, address, telephone number, date of birth (to verify you are at least age 18) and a valid email address. Please be aware that this information is also used to verify your eligibility AT THE TIME OF THE FINAL PROJECT DRAWING. Some states and regions may prohibit participation. BCDR will notify you on it’s website of any prohibitions we are aware of, but it is your responsibility to verify your eligibility. Any Entry Credits purchased are non-refundable.     3. Write in entry – NO PURCHASE NECESSARY. We’re glad you’re here and there’s no need to purchase anything from us to participate in the Games. Simply write to us at:

Limit one entry per mailing while supplies last. In order to help us prevent fraudulent entries, all written entries must be handwritten (legibly), including the sending envelope and the return envelope. You must include a self-addressed, stamped envelope with sufficient postage. All mechanically/computer generated submissions will be rejected without notice. Upon rejection of any entry, all costs, including postage, will be forfeited. After receipt and approval, one entry code will be sent to you allowing you to enter online for free. 

These are the only legitimate ways to enter the Games. The purchase, sale, trading, barter, or any other exchange of entries is prohibited. 

  1. Each entry has an equal chance of being selected in the Final Random Selection process. The number of entries is updated in near real time, with the exception of handwritten no-purchase necessary entries which are added to the entries within 3 business days of receipt and verification by BCDR. 

  2. Entry credits have no value and may not be exchanged or purchased for any monetary or transactional value. Should all project sweepstakes options have expired, no credits or returns are available. 

  3. Once you use an Entry Credit, it can not be used again. Should you not be selected as a winner on a project, you may not transfer Entry Credit(s) to another project. 

  4. BCDR is not responsible for any Entry Credits that may be lost due to power loss or computer-related interruption.

  5. Entry period – each Project has a predetermined entry period listed directly on the BCDR website. All entries must be submitted 72 hours prior to the Project’s Final Project Drawing (which is also listed on the website). 

  6. The potential winner for each Project will be selected by from all eligible entries in an electronic random prize drawing “Final Project Drawing”). Each potential winner will be contacted by email (we will use the membership registered email) within approximately two (3) days after the drawing. Each potential winner is required to claim the prize within ten (10) days of the date of prize notification. A failure to claim the prize within this time disqualifies any potential winner and an alternate potential winner may be selected. 

  7. Membership – BCDR requires membership in order to participate in the online voting process for each Project. Your membership also entitles you to additional features such as discounts, specialized merchandise, newsletters, and much more. With membership comes 5 Entry Credits to be used to vote on the options of your choice for the Project(s) of your choice. Your membership account information can be accessed on the website and you may change or correct your personal information at any time. Please be aware that any changes may affect your eligibility. If you submitted an entry while ineligible according to these official rules and/or according to the applicable laws, a change in your personal information will not make the said entry valid/eligible. Unfortunately, some municipalities, regions, or states may prohibit you from receiving the prize if you become inelligible even after an eligible and valid entry was submitted. Should such a change occur you become inelligble according to these Official Rules and you are not entitled to any compensation or award. Your account information will be held as long as permitted by law and will be governed/managed according to our Privacy Policy and Terms of Conditions. 

  8. Password – your account information and the login page require a password, to be selected by you. While BCDR requires a minimum standard for the password, we are not responsible to maintain the secrecy of the password, or for selecting the password of your choice. For additional information refer to the Terms of Conditions. Redeeming your password is easy, simply follow the online procedures listed under “Password Information.” 

  9. Credit card information – Please see our Privacy Policy and Terms of Conditions for more information regarding the storage, use, and protections related to the use of your credit card information. 

  10. Prize Description – the final Project is the prize. The features included in each Project are the result of the voting efforts made by each participant. The most votes selects each individual feature. Each voting round for each feature closes at a specified time on the Project’s page. Within 72 hours the final vote tally will be counted at the winning feature option will be incorporated into the Project. Once this is set it CANNOT BE CHANGED. By participating you understand that the awarded prize is the final version of the Project determined by the vote tallying process (majority vote wins) for each feature. You also understand that the final produced version of the Project may vary in color, style, or quality in what appears in the online predicted version. No warranties or promises, other than those listed within these Official Rules, is given. No portion of the prize may be transferred, redeemed for cash, or substituted (unless otherwise provided in these Official Rules and/or by and according to the express written permission of BCDR). Prize winner must have a valid Driver’s License and automobile liability insurance as required by law. 

  11. Claiming the Prize –  A “potential winner” of the Final Project Drawing prize must complete the claim process in order to receive the prize. 

    1. Within 72 hours of being selected a potential winner will be notified that they have been selected as the potential winner via the email address given in the membership registration or in the handwritten no purchase necessary entry letter.

    2. The potential winner must respond within 10 days of the notification in writing via email to [email protected] that they wish to receive the prize. They must also include a contact phone number in order for us to verify the information and arrange for delivery of the Project. 

    3. Once the response is properly received, BCDR will begin the process of verifying the eligibility of the potential winner over the next 30 days (after the response is received). 

    4. If the potential winner is ineligible they will be notified via email of his/her ineligibility and the reasons for his/her ineligibility. BCDR reserves the sole right to make all final determinations regarding eligibility. By participating all participants agree, to the fullest extent permitted by law, to settle any and all disputes according to the terms of Rules 28 & 29 below. 

    5. If the potential winner is determined to be eligible documents verifying a valid driver’s license, automobile liability insurance, and any other applicable documents required (including those for tax identification/withholding purposes) must be submitted via mail and/or email within 72 hours of the request. Failure to deliver any required documents will disqualify the claimant from eligibility for the prize. BCDR is not responsible for any lost or stolen documents during delivery; the participant assumes risk of loss, damage, theft, and delay of all documents sent to BCDR. It is recommended that insurance be secured prior to sending the documents. 

    6. Delivery of the prize – Prizes will only be delivered to the address listed in the membership registration at the time of winning entry submission, unless otherwise agreed upon in writing. Delivery will be conducted and managed by BCDR and is under its sole discretion. 

  12. All taxes, including but not limited to, federal, state and/or local income taxes on or associated with any prize, along with any reporting requirements, are your sole responsibility. BCDR will issue an IRS Form 1099  by January 31 of the year following the date in which the prize was awarded. If required by law, BCDR reserves the right to withhold and remit to the appropriate taxing authorities any amount(s) of due. If any prize is not available, BCDR reserves the right to substitute a prize of equal or greater value. Expenses not stated for any prize are the sole responsibility of the winner. If a potential winner cannot accept a prize, that prize will be forfeited in its entirety.

  13. BCDR and  its affiliates, vendors, officers, employees, representatives,heirs, ensigns, and partners are not responsible for any technical difficulties or failures of any kind including, but not limited to lost, interrupted, inaccessible or unavailable networks, servers, satellites, digital device(s), Wireless Service Providers, Official Websites or other connection, availability or accessibility problems arising in connection with or over the course of the Project. By participating in any of BCDR’s Projects, each Participant releases and agrees to hold BCDR and  its affiliates, vendors, officers, employees, representatives,heirs, ensigns, and partners harmless from any and all costs, injuries, losses or damages of any kind, including, any property damage, death and bodily injury (whether due to negligence or otherwise), due in whole or in part, directly or indirectly, to participation in any BCDR Project or any Project related activity, or the receipt, use or misuse of any prize. 

  14. Participants waive any right to reimbursement, compensation, or claim for any costs associated with winning and/or receiving any prize, including, but not limited to, any costs of verification, redemption, travel, and publicity which might arise Participant further waives any liability participant might incur associated with receiving any prize. 

  15. To the extent permitted by law, the potential winner agree and grant BCDR the right, but not the obligation, to the use of his/her name, voice and likeness, along with his/her address (city and state) and any statements made by or attributed to the potential winner in any and all media, without notice, review or approval, in perpetuity and throughout the world for advertising, commercial and promotional purposes in connection with BCDR’s activities without compensation, and releases BCDR and  its affiliates, vendors, officers, employees, representatives, heirs, ensigns, and partners from any liability with respect thereto.

  16. Participation Technical Requirements – to participate, other than via a handwritten no purchase necessary entry (see Rule 5.c), you will need, minimally, the following:

Desktop/Laptop System Requirements:

  • Supported Desktop OS/Browsers: Windows 7 to 10: Google Chrome™ 67, Firefox® 61; macOS 10.13: Firefox® 61; Google Chrome™ 67, Safari 11.1

Mobile System Requirements:

  • Supported Mobile OS/Browsers: Android 4.4+: Google Chrome™ 67; iOS 9+: Safari 11.1

  • Separate data and message charges may apply. 

Note: Browser must have JavaScript and Cookies enabled. 

Digital Device Requirements:

  1. Digital Device capable of displaying HTML and XHTML content is required. If a Participant’s phone does not meet these requirements, or they are having a technical issue viewing the site, then they will need to use their desktop computer to participate.

  2. Using a screen resolution lower than 320px wide may result in a Participant not being able to enter the Sweepstakes.

  3. Non-supported browsers and devices may be served a page stating the Participant’s browser or device is not supported with links to external pages (not associated with BCDR) to update the Participant’s browser or direct the Participant to play on a supported desktop/laptop computer to participate. Using a browser or device not supported may prevent participation in BCDR’s Projects and Final Project Drawings.

  4. While all efforts are made to support current browsers, operating systems and devices, new operating systems, browsers and devices may not be supported if brought to market after the development of BCDR’s website. BCDR is not responsible for any browser, operating system or device supporting issues.

  1. DISCLAIMER OF WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY LAW THE SPONSOR MAKES NO WARRANTIES, AND HEREBY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESSED OR IMPLIED, CONCERNING ANY PRIZE IN CONNECTION WITH BCDR’S PROJECTS. ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, AND BCDR HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY.

  2. Disqualification: If BCDR determines, at its sole discretion, any potential winner to be ineligible, or to not have complied with these Official Rules, or to have declined a prize for any reason prior to award, the potential winner will be disqualified and the prize forfeited. Entries made by any individual or any entity other than the Participant and/or originating by any other mechanism, including but not limited to commercial sweepstakes subscription notification and/or entering services, will be declared invalid and disqualified. BCDR reserves the right in its sole discretion to disqualify any individual determined to be tampering, disrupting, or unfairly influencing the operation of any Project or Final Project drawing. In addition BCDR reserves the right to disqualify any participant or potential winner who abuses, threatens, or harasses any other participant or any of BCDR’s employees, representatives,  affiliates, vendors, officers,heirs, ensigns, or partners

  3. Termination of Projects –  BCDR reserves the right, without prior notice and at any time, to terminate, suspend or modify any Project(s), if it determines in its sole discretion, that a Project(s) has been compromised or that fraud or technical problems, failures, malfunctions or errors have destroyed or severely undermined the proper performance, integrity and/or feasibility of the Project. 

  4. Force Majeure – In the event BCDR is prevented from continuing with any Project as by any event beyond its control, including but not limited to fire, flood, natural or man-made health epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within BCDR’s control, BCDR shall have the right, to the extent permissible by law, to modify, suspend, extend or terminate any Project. 

  5. Invalidity – Should any clause, section, or portion of this agreement be found to be illegal, invalid or unenforceable such determination shall not affect the validity or enforceability  of any other clause, section or provision and the balance of the agreement shall remain in effect. 

  6. Headings – Any headings, titles, or captions used in these Official Rules are only for reference, and shall not be used to determine the meaning or intent of any clause or provision. These Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of BCDR. 

  7. Governing Law – These Official Rules and this Agreement shall be governed by, and construed in accordance with, the laws of the State of California. 

  8. Arbitration – By participating in any Project, the Participant agrees, to the fullest extent permitted by law, that:

    1. any controversy or claim (whether contract, tort, or otherwise) arising out of or relating to this Agreement, including a breach of this Agreement, will be resolved exclusively by final and binding arbitration administered by JAMS and conducted before a sole arbitrator pursuant to JAMS’s Comprehensive Arbitration Rules and Procedures (“Rules and Procedures”); 

    2. this Agreement, including the arbitration portion, is made pursuant to a transaction involving interstate commerce, and must be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1-16; 

    3. the arbitration will be held at a location determined by JAMS according to the Rules and Procedures and is reasonably convenient to the claimant, or at another location mutually agreed to in writing by the claimant and BCDR; 

    4. the arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the Participant may have entered into in connection with the Project(s) and the arbitrator shall apply California law consistent with the FAA and applicable statutes of limitations; 

    5. Participant and BCDR waive any right to assert a claim(s) in any class or representative action, arbitration can only decide the Participant’s and/or Sponsor’s individual claims, and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated;

    6. in the event that the administrative fees, arbitrator fees, and filing fees associated with the arbitration exceed $500, Sponsor agrees to pay said fees exceeding $500 for Participant until a determination is reached. In addition, if the Participant is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, BCDR will pay as much of the Participant’s fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive, upon a determination all fees and cost paid will be either deducted from any award in Participant’s favor, or will become due should BCDR prevail;  

    7. if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal  then the balance of this arbitration provision remains in effect, with the exception that if subpart (e) is found to be invalid, unenforceable or illegal, then the entirety of Rule 29 “Arbitration”) is null and void, and neither BCDR nor Participant is entitled to arbitrate their dispute; and

    8. this arbitration provision is reciprocally binding on all parties, such that both Participant and BCDR are required to arbitrate their claims against one another. For more information on JAMS and/or JAMS Rules and Procedures, Participants may visit the JAMS Official Website at http://www.jamsadr.com.

  9. Printed Copy – To receive a copy of the Official Rules, mail a handwritten self addressed envelope with the necessary postage affixed to BCDR:  Official Rules Request, P.O. Box _________, __________, CA ________ Vermont residents with a return address located in Vermont may omit return postage. Limit one (1) request per outer envelope.
